Terms of Service

1. Eligibility

You must be at least 16 years old, or the age of legal majority in your jurisdiction, to use our Services. By using our Services, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Accounts

Some of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
• Reverse engineer, decompile or attempt to extract the source code of our software, except where permitted by law;
• Interfere with, disrupt or attempt to gain unauthorized access to our Services, systems or networks;
• Upload or transmit malicious code, spam or content that infringes the rights of any third party;
• Use automated means to access or scrape the Services without our prior written consent.

4. Subscriptions and Payment

Certain features of our Services may be offered on a paid or subscription basis. Where applicable, pricing, billing frequency and cancellation terms will be presented to you at the time of purchase. Unless otherwise stated, fees are non-refundable. We reserve the right to change our pricing with reasonable advance notice.

5. Intellectual Property

The Services, including all software, designs, text, graphics and other content we provide (excluding content you submit), are owned by Pequoid Software LLC or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. Any content you submit through the Services remains yours, but you grant us a license to host, store and process it solely to operate and improve the Services.

6. Third-Party Services

Our Services may integrate with or link to third-party platforms, app stores or services (such as Microsoft Azure, app marketplaces or analytics providers). We are not responsible for the content, policies or practices of any third party, and your use of those services is governed by their own terms.

7. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or completely secure.

8. Limitation of Liability

To the maximum extent permitted by law, Pequoid Software LLC and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after any changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
